Developments in LNG pricing and price reviews under LNG SPAs in Asia-Pacific

Abstract

At a time when there is increasing, possibly unprecedented, discussion and speculation about the future structure for the pricing of Australian LNG into Asian markets, it is appropriate to reflect on the present market position, assess likely areas of risk and change and discuss potential outcomes. Many in the LNG industry refer to a paradigm shift in pricing, others to a period of transition; either way, change is upon us and the implications for LNG sellers are significant. This extended abstract highlights the key drivers of this change and it discusses models for price reviews and how these reviews may evolve in coming years.

Angus Jones is a partner of international law firm Allen & Overy, based in Perth. He has a B. Law (Hons), B. Jurisprudence and B. Commerce, all from UWA. He is a member of AIPN, AMPLA and the Law Society WA. His practice includes a range of energy and resources clients and projects, with an emphasis on the oil and gas industry and LNG projects around the world.

Michael Young is a partner of Allen & Overy and Co-Head of the Firm’s Global Arbitration Practice. He has an MA (Law) from Cambridge and a BCL from Oxford. He sits on the ICC Court of Arbitration. He is also a member of the LCIA, ASA, IAI and the Federation for International Arbitration Advocacy. He has a specific focus on energy, chemicals and natural resources disputes worldwide and frequently acts as an arbitrator. He has written and lectured widely on the issues of international arbitration and teaches at both the University of London and Sciences Po in Paris.
